Nick Roth, an EysterKey partner, with over 36 years of litigation experience, practices in all areas of civil litigation. He has also served as a mediator for more than 18 years. A primary focus of his litigation experience has been medical negligence cases where he has tried to a verdict approximately over 100 complex jury trials. He has also tried a large number of civil jury cases from motor vehicle negligence to complex product liability litigation.

Mr. Roth has substantial experience in other complex litigation, including class actions. He has served on the steering committee or in the management structure of a number of Multi-District Litigation cases in Federal Court. Among these are In Re: Managed Care, a class action suit by more than 900,000 physicians against the ten largest for-profit health insurance companies; Love v. Blue Cross Blue Shield, a putative class of all physicians in the country against every Blue Cross Blue Shield entity in the United States; and In Re Mattel, Inc., Toy Lead Paint Products Liability Litigation, MDL 1897, where he served as one of ten members of the executive committee. He is currently litigating an Antitrust case against all Blue Cross and Blue Shield companies in the U.S. and Puerto Rico on behalf of all BCBS contracted Providers and a case against the three largest PBMs on behalf of a class of independent Pharmacists.

He is admitted to practice law in the State of Alabama and in the United States District Courts for the Northern and Middle District of Alabama, as well as before the United States Court of Appeals for the Eleventh Circuit, and the Supreme Court of the United States of America.

He has been admitted pro hac vice for the purpose of litigating a case in the United States District Court for the Northern and Central District of California; United States District Court for the Eastern District of Kansas; United States District Court for the Southern District of Mississippi; United States District Court, District of New Jersey; United States District Court, Northeastern District of Illinois; United States District Court for the Southern District of Florida; United States District Court for the Northern District of Ohio; United States District Court, District of Maine; Court of Common Pleas of the State of South Carolina, County of Richland; United States District Court for the District of Nevada; and the Superior Court of the State of California, County of San Diego.

Mr. Roth is a Fellow in the American College of Trial Lawyers, an organization which elects its Fellows from no more than one percent of the practicing bar in any state. He is also included in the 2008-2017 Super Lawyers where he is listed as one of the top Mass Tort and Complex Litigation lawyers. He is listed as one of the Best Lawyers in America in Commercial Litigation and Personal Injury in the U.S. News and World Report, 2015-2017.
